Terms of Service

Welcome to SmartInvoice ("the Service") ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of SmartInvoice, including our website, web application, APIs, and any related services.

By creating an account or using SmartInvoice, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be:

  • At least 16 years old
  • Legally capable of entering into a binding contract
  • Using the Service in compliance with all applicable laws and regulations

If you use SmartInvoice on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of the Service

SmartInvoice provides invoice processing tools including:

  • Reading user Gmail messages containing invoices
  • Extracting attachments from invoice-related emails
  • Parsing invoice data
  • Generating and managing invoices
  • Storing and organizing documents
  • Managing client information

The service may evolve over time and new features may be added, modified, or removed.

3. Google API Data Access

If you choose to connect your Google Account, SmartInvoice will request permission to access certain Gmail data solely for the purpose of:

  • Identifying invoice emails
  • Extracting attachments
  • Processing and organizing invoice data

SmartInvoice complies with the Google API Services User Data Policy, including the Limited Use Requirements. We do not use Gmail data for advertising or non-functional purposes.

4. Your Account

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Ensuring all information you submit is accurate
  • All activities that occur under your account

We may suspend or terminate accounts for:

  • Violations of these Terms
  • Illegal activity
  • Abusive or harmful behavior
  • Attempts to circumvent system security
  • Non-compliance with Google API policy requirements

5. Acceptable Use

You agree not to use SmartInvoice to:

  • Violate any law or regulation
  • Access another user's account or data without permission
  • Upload harmful, illegal, or infringing content
  • Interfere with or disrupt the Service
  • Perform automated scraping or data harvesting beyond the intended functionality
  • Attempt to reverse engineer or modify any part of the system

We reserve the right to investigate and take appropriate action against prohibited conduct.

6. Intellectual Property

All rights, titles, and interests in SmartInvoice—including software, content, branding, and design—are owned by SmartInvoice or our licensors.

You retain ownership of:

  • The invoices you create
  • Files or documents you upload
  • Data extracted from your Gmail account

By using the Service, you grant us a limited, non-exclusive license to process your data solely for providing the Service.

7. User Content

You are solely responsible for any content you upload, submit, or process through SmartInvoice.

You represent that:

  • You own or have sufficient rights to the content
  • Your content does not violate intellectual property laws
  • Your content does not contain harmful or illegal material

We reserve the right (but not the obligation) to remove content that violates these Terms.

8. Data Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your data—particularly Gmail data.

You agree that:

  • We may process your data to provide the Service
  • We may store uploaded files and extracted invoice data
  • We may use anonymized or aggregated data for analytics and platform improvement

We do not sell or share your personal data with advertisers.

9. Payment and Billing

If SmartInvoice offers paid plans, you agree to:

  • Pay all applicable fees
  • Provide accurate billing information
  • Allow recurring charges where applicable

Fees are non-refundable unless required by law.

We may change pricing with prior notice.

10. Third-Party Services

SmartInvoice integrates with third-party services such as:

  • Google Cloud Platform
  • Firebase Authentication
  • Gmail API
  • Cloud Run

Your use of third-party services is subject to those parties' terms and policies.

We are not responsible for outages, errors, or data loss caused by third-party services.

11. Availability & Disclaimer of Warranties

SmartInvoice is provided "as is" and "as available", without warranties of any kind.

We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Data will be preserved without loss
  • Parsing or extraction algorithms will be perfectly accurate

To the maximum extent permitted by law, we disclaim all implied warranties.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for lost profits, lost data, indirect damages, or consequential losses
  • Our total liability for any claim is limited to the amount you paid us in the past 12 months (or €0 if you use the free version)

Some jurisdictions do not allow limitations of liability, so these limits may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless SmartInvoice from any claims, damages, or liabilities arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your content or data
  • Misuse of Google APIs via your account

14. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You misuse Gmail API access
  • Required by Google, regulators, or applicable law
  • Service operations require discontinuation

You may stop using SmartInvoice at any time.

Upon termination:

  • Your access will be disabled
  • Your data will be deleted according to our Privacy Policy

15. Changes to These Terms

We may update these Terms at any time.

If we make material changes, we will notify you by email or in-app notice.

Continued use of the Service after changes constitutes acceptance.

16. Governing Law

These Terms are governed by:

  • The laws of Norway,

Except where superseded by mandatory local law.

Disputes will be resolved in the courts of Norway, unless otherwise required by law.
